The proceedings concerning the audio leak involving Bushra Bibi and Najmus Saqib, the son of former Chief Justice Saqib Nisar, have been suspended by the Supreme Court, along with the rulings of the Islamabad High Court dated May 29 and June 25.
Judges Aminuddin and Naem Akhter Afghan made up the two-member bench that heard the case.
Enquiring as to whether the two parties involved in the audio were behind the leak, Justice Aminuddin questioned the high court’s decision.
Every time someone tries to access the phones, a stay order stops them, according to Additional Attorney General Amir Rehman.
The Additional Attorney General further argued that in using its Suo Moto powers, the Islamabad High Court exceeded its jurisdiction.
He stated that while tapping without authorisation is already illegal, even legitimate counterterrorism measures are being hampered by the ruling of the Islamabad High Court.
In addition to forbidding government entities from tapping phones, Justice Babar Sattar had instructed mobile phone providers to restrict data access.
Former Speaker of the National Assembly Raja Pervez Ashraf formed a committee to gather information about audio leaks, and Najmus Saqib filed a lawsuit against the committee at the Islamabad High Court.
The assembly’s dissolution resulted in the committee’s lapse.
